Relationships and Marriage: When to finally say it is over

This is the second marriage for both me and my husband. We both had kids from previous marriages.

He is a functioning alcoholic, in denial, and will not get help.? Our marriage is falling apart, we sleep in

separate rooms, we never communicate, we have been to counseling but he will not do what the counselor

says. We split the household bills and each pay our own bills which is getting to be a burden on me because

the debts I have were based on our joint income. I feel so hurt, alone, unsupported. He even took a vacation with

his children and left me and my children at home, talk about hurt!? I'm at the end of my rope. I've cried out to God

and prayed and prayed but nothing seem to change. When do you finally say enough is enough?

Has Your Company Appointed a 'Master of Disaster' Yet?

In an earlier blog I discussed how global supply chains had been severely disrupted in recent years. I also discussed how the role of the Business Continuity or Supply Chain Risk Manager is becoming increasingly important. But how many companies actually have a Business Continuity Manager or ??Master of Disaster? within their business and what exactly does the role entail?

I guess the Master of Disaster could be referred to as a sort of supply chain super hero and this post is quite timely given that the new Avengers film was recently released. I wonder how the Master of Disaster would stack up against Iron Man, Captain America or the Incredible Hulk! ?One thing is for sure, in true super hero style they would need some sort of costume, now this is where the Master of Disaster would have to do some work to create a unique identity as a quick check on Google did not reveal many suitable costumes, however I have given them a helping hand by developing an appropriate, supply chain themed, logo :)

So why is the Master of Disaster so important, what roles do they undertake during a period of disruption?, how do they communicate both internally and across the extended enterprise? and what IT tools do they use to manage disruption? There are certainly a lot of questions that need answering here, but given their importance and relevance in managing today?s supply chains I thought I would try and introduce some of their key roles and activities.

Recent supply chain disruptions have certainly brought an element of nervousness to many companies. ?Companies and indeed regulatory bodies are looking ever more closely at an organisation?s ability to not only recover from a disaster, but reduce the chances of supply chain disruption happening again in the future. ?Ten years ago companies were focused on disaster recovery, how long would it take a business to recover from a disaster. ?Today however things have moved on and companies are more interested in how they keep their businesses running during a period of disruption. ?This particular process is referred to as Business Community Management. ?Essentially this process provides an ability to recover from any given event and this area is certainly becoming important from a competitive differentiation point of view. ?After all, if you can either continue production or offer some form of service during a period of disruption then your company will be seen as offering excellent customer service and ultimately customer satisfaction levels will increase significantly.

Business Continuity Management (BCM), as defined by the Business Continuity Institute, can be considered as a management process that identifies potential impacts that threaten an organisation and provides a framework for building resilience and the capability for an effective response which safeguards the interests of its key stakeholders, reputation, brand and value creating activities. The British Standards Institute (BSI) provides a really useful website for understanding more about this particular subject area, click here.?In fact BSI has released a ten point guide to the key things you should know about BCM, you can download their guide here

The Business Continuity Manager, aka Master of Disaster, helps to ensure that people, services or back up procedures are mobilised to fix any issues that may arise and make sure this is communicated succinctly to the affected areas of the business. Business Continuity Managers can also help to identify potential bottle necks, or points of weakness/single points of failure across a supply chain. Business Continuity Managers will also help to prioritise where efforts or the focus should be in recovering from a specific disruption. Without a suitable Business Continuity Management process in place, decision making will have to be taken on the fly and this will inevitably lead to errors being introduced to your supply chain processes.

As I mentioned in my earlier blog entry, many companies, especially those with truly global supply chains have established control towers so that they can monitor their supply chains very closely. I also discussed how these control towers were now doubling up as crisis management centres during a period of disruption. IT and B2B technologies play an important role in assisting a Business Continuity Manager with trying to minimise the effects of disruption across the supply chain.

The area of information management and collaboration across a supply chain or trading partner community is certainly one of the more important areas that a Business Community Manager will be asked to focus on. I would certainly expect to see the Business Continuity Manager as a key user of a solution such as GXS RollStream which I briefly introduced in my earlier blog entry. ?The ability to:

  • identify alternative suppliers very quickly
  • send out a mass communication to potentially thousands of suppliers at the click of a button
  • undertake an assessment of the state of your supply chain following a natural disaster
  • establish some form of supply chain risk database where you can analyse assessment response trends etc, especially relating to how supply chains were brought back online following a period of disruption

This is an area that I will take a deeper look into via a future blog entry, but in the meantime if you are interested in seeing a recording of a supply chain risk related webinar that I conducted last week then please click here.

How can I find personal and business networking? marifunc.org

Unfortunately, many people feel uncomfortable in the networking process. They tend to feel unknown how to start, are too shy to attend events alone, don?t feel comfortable starting a conversation and don?t know how to maximize benefits of networking.

Recently, i?ve been using http://meetup.com to find business or entrepreneur related groups in my local area. I only went to one, but I managed to network with 2 people I intend to maintain a relationship with.

It sounds difficult, but when all of you are searching for business networking, it makes the process much easier.

Attorneys ? Corporate Defamation Online - Mudd Law Offices

In a series of articles focusing on Internet legal issues, Mudd Law Offices will help explain basic concepts about which individuals and entities need to be concerned. ?In this article, I discuss issues relating to Internet defamation about corporations, not for profit organizations, or other organizations.

Defamatory statements online can cause significant harm. ?Given the?ubiquitous use of search engines, nearly any website or webpage containing statements ? good or bad ? about a company can appear in search results. ?Moreover, with search results scraping various portions of the relevant text to provide content to the search terms, the results alone may convey the defamatory statements that appear online about corporations.

Many of the statements that corporations find to be defamatory arise from consumers or customers posting comments on so-called gripe sites. ?In other cases, competitors will often use shills to post negative statements about competing products or companies on gripe sites or other mainstream portals for reviews.

When a corporation or corporate entity first learns of the negative defamatory content, it often seeks guidance from in-house counsel. ?A corporation?s general counsel will often seek input from outside counsel. ?Regardless, it becomes essential for a corporation to obtain Internet legal counsel promptly for three significant reasons.

First, an expired statute of limitations will bar any ability to pursue claims against the individual or individuals who posted the defamatory comments. ?A statute of limitations represents a window of time within which a lawsuit needs to be filed. ?Often, the statute of limitations for defamation will be one year. ?However, statutes of limitations vary from state to state. ?Consequently, it is imperative that counsel be obtained from an Internet attorney familiar with defamation law at the earliest opportunity.

With respect to content on the Internet, a statute of limitations will often begin upon the first date of publication. ?Under this ?single publication rule,? it matters not that the content remains on the Internet and a company learns of the content only after the statute of limitations has elapsed. ?Rather, the statute of limitations will begin to start counting down from the first date the content appeared online. ?For this reason, an Internet or Cyberlaw attorney should be consulted immediately upon learning of the content.

As a side note, the foregoing represents a basis to suggest that a corporation or entity assign an individual to periodically search for the entity?s brands, products, services, marks, trademarks, titles, Intellectual Property, tradenames, legal names, etc.

A knowledgeable Internet or Cyberlaw lawyer will understand the application of the statute of limitations and be able to guide you appropriately. ?Depending on the circumstances, a variety of options may be available to a defamed party.

Second, many hosts and Internet Service Providers (ISPs) will retain information about the post and the party who posted the information for a short, limited amount of time. ?In fact, this time period often will be less than the statute of limitations. ?Thus, it becomes even more of an imperative that a corporation or entity consult with a knowledgeable Internet or cyberlaw attorney promptly. ?An attorney well-versed in this area of law will be able to efficiently guide a process of obtaining the potentially identifying information including, but not limited to, Internet Protocol (IP) addresses. For, if you cannot obtain the information that will lead to an individual?s identity, a company may well be left without an adequate remedy despite the statute of limitations not having lapsed.

Finally, for purposes of this article, and perhaps most importantly, the longer content remains on the Internet, the more a reputation can be harmed. ?Indeed, the longer content remains on the Internet, the more pervasive the content becomes. ?Many search engines will gauge a page?s importance by the number of times the page is ?hit? or visited or read. In this case, increased activity on a page will increase its ranking and make it more visible to the person searching for particular key terms. ?Thus, the imperative will be to secure the removal of the content promptly and efficiently.

This last point leads to a discussion of when litigation will be the best strategy and when alternative means of securing the objective will be more appropriate. ?An Internet attorney knowledgeable of defamation and cyberlaw will best be able to guide a party to the best, most efficient, and most economical approach to take.

Should you have any specific questions you wish answered, please feel free to contact me at Mudd Law Offices. ?While Mudd Law Offices cannot provide specific legal advice unless one becomes a client, we can provide general comments on these legal issues.

What is a DJ? Everyone who considers him or herself one can probably give you a unique answer. Is everyone with a music collection and a sense for good timing a DJ, or does their music collection have to exceed a certain number of gigabytes or slabs of vinyl to be in the club (no pun intended)? Audio playback devices are certainly getting more plentiful and powerful on a large scale; anyone who's played with an iOS DJ app can tell you that. In the deeper end of the DJ pool, things aren't expanding at such a frantic pace. But every once in a while a new toy crops up that adds depth and breadth to the way music nerds play back music. Native Instruments' just-released Traktor Kontrol F1 is a blinking slab of rainbow-tinged hardware with an intense devotion to manipulating samples. While boxes from Roland and Akai have been defining genres for decades, this 16-pad add-on takes the sampling game to a new arena. Will DJ's want it? We feel it's safe to say they will. At $279, should they buy it? That question's a little more complicated.

Apple CEO on friending Facebook, educating Siri and killing Ping

5 hrs.

Apple CEO Tim Cook sat down for an in-depth?interview during the? All?Things?Digital conference in?Rancho Palos Verdes, California on Tuesday.?Cook discussed where Apple's been and ??more importantly ??where it's going. He also slipped in some hints about the future of Siri, the doom of Ping, and a potential relationship between Apple and Facebook.

Cook started his conversation with his hosts, Kara Swisher and Walt Mossberg, by declaring that he has never been as amazed by "all the things [he] cannot talk about" right now. "The juices are flowing and we have some incredible things coming out," he explained.

While Cook touched on a range of topics, including Apple's manufacturing plans, during the interview, my ears twitched when he mentioned good ol' Ping.?

Ping ??iTunes Ping, to use its proper name ??is a social network of sorts that's baked into Apple's desktop?media player software. The feature was not received particularly well by most users, who criticized its limited availability, the?prevalence?of fake celebrity accounts, the removal of Facebook integration, and initial waves of spam.?

When asked about what happened to Ping, Cook explained that it seems as if the average customer is saying that it "isn?t something that [he or she wants] to put a lot of energy into."

"Will we kill it? I don't know. We'll look at that," he remarked before host Swisher quipped that Apple could "totally sell [Ping] to Google+."

While it sounds as if Ping is doomed, there is potentially brighter news when it comes to other social network integration. Cook remarked that "Facebook is a great company" and that he has "great appreciation for them."

?We have great respect for them," he emphasized, again."?I think we can do more with them. Just stay tuned on this one.???

Sounds like Facebook and Apple might be changing their relationship status settings at some point in the near future. Hopefully the social network won't get jealous of all the attention Apple is giving Siri, the personal assistant built into the latest generation iPhone, though. Because Siri is definitely here to stay for a while.

?Customers love it. It?s one of the most popular features of iPhone 4S," Cook told Swisher and Mossberg. "But there?s more that it can do, and we have a lot of people working on this. And I think you will be really pleased with some of the things you?ll see over the coming months on this. We have some cool ideas about what Siri can do. We have a lot going on on this.?

You can catch up on other details from Cook's interview on the All Things Digital website, where Ina Fried?has ?compiled?plenty of notes, quotes and pictures.

Want more tech news, silly puns, or amusing links? You'll get plenty of all three if you keep up with Rosa Golijan, the writer of this post, by following her on?Twitter, subscribing to her?Facebook?posts,?or circling her?on?Google+.

China's Economy: Seizure or Cancer? | The Diplomat

The sharp slowdown in China?s economy has policy makers around the world watching carefully. Will the government have the courage to change course?

The unexpectedly sharp slowdown of the Chinese economy has fanned anxieties around the world. Based on the latest figures released by the Chinese government, the economy slowed more than expected in the first quarter of this year compared with the fourth quarter of last year. Is the once unstoppable Chinese economic growth engine grinding to a halt?

For the West, deteriorating growth in China is obviously bad news. With Europe sinking into recession and the United States mired in an anemic recovery, growth in emerging markets, China in particular, has been a bright spot in an otherwise bleak economic landscape. As the world?s second-largest economy, annual growth at high single digit (8 percent to 9 percent) makes China the largest contributor to global GDP growth. Now that China is faltering, many worry not only about the effects of China?s stagnant growth on the rest of the world, but also about its impact on China itself.

On the surface, the recent precipitous drop in growth in China is the result of two factors. The first is the tightening of monetary policy adopted last year to cool the real estate market and fight inflation. The second is the rapid decline of export orders for Chinese goods, a development closely associated with the escalating debt crisis in Europe.

Had the Chinese economy been more balanced between domestic demand and exports and between household consumption and investment, monetary tightening and falling exports would not have had such dampening effects on growth. But the Chinese economy is highly unbalanced (although compared with a few years ago, China?s internal-external imbalances have moderated significantly), thus making the country less able to cope with the knock-on effects of credit-tightening and disappearing external demands.

In the short-term, most analysts are worried about a possible ?heart attack? for the Chinese economy. Under this nightmarish scenario, plunging growth will expose China?s highly leveraged local governments, real estate developers and state-owned enterprises to the risks of insolvency and default while China?s export sector, dominated by foreign companies and domestic small and medium-sized private firms, contracts and lays off workers. The nasty feed-back loop looks like this: falling growth will greatly reduce the financial viability of the projects in which China has overinvested in the last three years. Such projects include real estate developments, heavy industries, and infrastructure (the most infamous example being the scandal-ridden high-speed rail system). Falling growth means lower demand. These projects won?t be able to charge higher enough prices to make a profit. Because they were financed with bank debt, it?s almost certain many of these projects will default.

In most other countries, such a crash would lead to a banking crisis, hence the ?heart attack? scenario.

But China is different. Because the banking system is effectively owned and controlled by the state, a banking crisis won?t materialize unless the state itself is insolvent and Chinese depositors have completely lost confidence in the state?s sovereign guarantee of its banks. This unique character of the China?s state-owned financial system is the cause of the country?s inability to allocate capital efficiently. However, in the short term, this structural flaw may turn out to be an asset in averting a seizure of the financial system.

The Chinese government has already taken measures to prevent such a seizure. Last year, Beijing ordered a one-year moratorium on repayment of loans made to local governments and their highly leveraged financing platforms, thus delaying the day of reckoning. As the economy continues to struggle, one should expect the Chinese government to extend this moratorium to give local governments more time.
